Eligibility
You must have the legal capacity and authority to form a binding contract on behalf of yourself or the business you represent to create an account.
These terms govern access to and use of OrcaLinq, operated by Orca Linq. Additional order forms, data processing terms, or enterprise agreements may supplement or override parts of these terms.
Use of the service
You may use the service only in accordance with applicable law, platform rules, channel provider terms, and tenant policies. You are responsible for users, agents, content, credentials, domains, and connected tools under your account.
Channel and AI BYOK
When you connect provider credentials, you represent that you have authority to use them. Provider fees, template approvals, messaging limits, AI usage, and compliance obligations with those providers remain your responsibility.
Acceptable use
Do not use the service for spam, bulk unsolicited campaigns, unlawful surveillance, credential theft, malware, harassment, regulated advice without proper controls, or attempts to bypass rate limits and security controls.
WhatsApp and Meta platform terms
Messaging delivered through WhatsApp is subject to the WhatsApp Business Messaging Policy, the WhatsApp Business Terms of Service, and Meta's platform terms, in addition to these terms. By sending messages through the service on WhatsApp you agree to those terms and accept responsibility for complying with them. You must obtain and be able to evidence opt-in consent from each recipient before messaging them, use message templates only in their approved category, and honour opt-out requests. We honour recipient opt-outs at the platform level: a recipient who replies STOP is suppressed for your account, including business-initiated template messages, until they resume. Meta may independently restrict, suspend, or remove a phone number, template, or WhatsApp Business Account for policy or quality reasons, and those decisions are outside our control.
Customer data
You retain ownership of your customer data. You grant us the rights needed to host, process, route, secure, display, analyze, and transmit that data to provide the service and enabled integrations.
Intellectual property
We retain all rights, title, and interest in and to the platform, including its software, architecture, and documentation. You may not reverse engineer, decompile, or otherwise attempt to derive the source code of the service.
Billing
The price shown at checkout is the total amount charged for the period stated there. Paid access is granted for the period you pay for; we do NOT store your card or charge it again automatically, so nothing renews unless you choose to pay again. Additional websites are billed per site per month on the same subscription. Top-up customer packs are one-off purchases, not subscriptions: they do not renew, they are used only after your plan's included customers are exhausted, and they remain valid for the period stated at purchase. Payments and card data
Payments are processed by our payment gateway on their own hosted checkout. We never see, handle, or store your full card number — only the gateway's transaction reference, the amount, the currency, and the outcome. A failed or disputed payment may suspend paid features; it does not delete your account or your data.
Taxes
Where we are not registered for GST, no GST is charged or collected and none is withheld from any refund. If tax registration applies, tax will be shown as a separate line at checkout and on your invoice rather than absorbed into the same headline price.
Provider fees you pay directly
Fees payable to third parties for your own accounts — WhatsApp/Meta, Telegram, LINE, SMS, and AI model providers when you bring your own key — are billed by those providers to you. They are not collected by us, never marked up by us, and are not refundable by us.
Availability and changes
We aim to provide a reliable service, but features may change as the product evolves. Beta, preview, and experimental features may be modified, limited, or discontinued.
Termination and suspension
We reserve the right to suspend or terminate your access to the service immediately and without notice if you violate these terms, fail to pay fees, or if your usage poses a security risk to the platform or other users.
Indemnification
You agree to indemnify and hold harmless the platform, its operators, and affiliates from any claims, damages, liabilities, and expenses arising out of your breach of these terms or misuse of BYOK integrations.
Liability
To the maximum extent permitted by law, the service is provided without warranties beyond those expressly stated in a written agreement. Our aggregate liability is limited as described in the applicable order, agreement, or these terms.
Governing law and dispute resolution
These terms shall be governed by the laws of India, without regard to its conflict of law provisions. While the service is intended for global users, any disputes arising out of or related to these terms or the service shall be subject to the exclusive jurisdiction of the competent courts in India, unless mutually agreed otherwise in writing.
